Real Estate

From the agreement to closing.

Whether you are buying your first home, selling a commercial property or refinancing, the agreement and the closing documents need to reflect the deal you intend to make. Akash reviews the terms, identifies the issues to resolve before closing and works with the parties involved to complete the transaction.

How we can help

Residential purchases and sales

Get help reviewing the agreement of purchase and sale, checking title, coordinating with your lender and preparing for closing. On a sale, we review existing mortgages and other items that need to be addressed so closing funds can be distributed.

Commercial property transactions

We assist with purchases and sales of commercial property. Depending on the deal, the review may include leases, title matters, financing, due diligence conditions and any documents or undertakings needed at closing.

Mortgages, refinancing and private lending

We review loan terms and security documents, coordinate mortgage registrations or discharges and assist borrowers or lenders with funding. We can also discuss independent legal advice where the transaction calls for it.

Commercial leasing

We review and negotiate lease provisions such as rent and additional charges, renewal options, assignment rights and personal guarantees. We can also assist with an assignment or consent when a business changes hands.

02 / The process

What to expect

  1. Review the deal

Identify the property, deadlines, conditions and any terms that need clarification.

  2. Prepare for closing

Review title and relevant documents, coordinate financing and confirm the funds or payouts required.

  3. Complete the transaction

Arrange signatures and exchange funds and documents. Where applicable, register the transfer or mortgage and report to you.

03 / Common questions

Before you get started

This page provides general information. For advice about your matter, speak with a lawyer.

When should I involve a real estate lawyer?

If possible, reach out before signing or waiving a condition, especially if the property, financing or terms are unusual. If you have already signed, share the agreement and your deadlines as soon as you can.

What should I budget for besides the purchase price?

Depending on the deal, closing costs can include land transfer tax, registration charges, title insurance, legal fees and adjustments for items such as prepaid property taxes. Ontario offers a land transfer tax refund to eligible first-time homebuyers.

What does a title search cover?

A title search reviews registered records for the property. It can show ownership, mortgages and interests such as easements. The agreement and property may also call for other checks outside the land registry.
